Terms of Use
These terms apply to access to Textmerce websites, demonstrations, software services, and the optional Textmerce SMS program. Additional commercial terms may apply to a paid subscription or signed agreement.
Service
Textmerce provides software and AI-assisted workflows for ecommerce messaging, campaign planning, analysis, social-service ordering, and related business operations. Features may change as the service develops.
Authorized use
You may use Textmerce only for lawful business purposes and in compliance with applicable platform rules, privacy laws, messaging regulations, and contractual obligations.
Textmerce SMS program
The Textmerce SMS program is optional and is limited to customer support and account or service-related notifications requested or expected by the recipient. Message frequency varies. Message and data rates may apply.
To join, you must actively select the unchecked consent box on the Textmerce SMS consent form and submit your phone number. Consent is not a condition of purchase. You may opt out at any time by replying STOP. Reply HELP for help, or contact anass@textmerce.com.
After an opt-out request, Textmerce may send a final confirmation that the opt-out was processed. We do not use purchased contact lists for this program.
Customer messaging responsibility
Business customers using Textmerce messaging workflows are responsible for ensuring that recipients of SMS, MMS, email, or other communications sent through their use of Textmerce have any consent required by applicable law, and for maintaining opt-out and suppression practices.
Prohibited use
You may not use Textmerce for unlawful spam, deceptive practices, harassment, impersonation, malware distribution, unauthorized data collection, or attempts to bypass technical or compliance safeguards.
AI-assisted output
AI-generated analysis and suggested copy may require review. Textmerce does not guarantee revenue, conversion lift, deliverability, legal compliance, or the accuracy of every generated recommendation.
Accounts and security
You are responsible for safeguarding account credentials and for activity performed through your authorized account. Notify us promptly if you believe an account or credential has been compromised.
Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, third-party outages, or other events may temporarily affect service.
Third-party services
Textmerce may integrate with third-party providers. Their products, availability, pricing, and terms are controlled by those providers.
Limitation
To the extent permitted by applicable law, Textmerce is provided without guarantees of specific commercial outcomes. Any separate signed agreement may contain additional warranty, liability, or service-level terms.
